End User License Agreement

This License Agreement governs your installation and use of the Vidima desktop application. It is between you, the Licensee, and Helvecraft, the Licensor. The license is personal, perpetual within the v1.x line, and tied to one device.

By installing or running Vidima you accept this Agreement. If you do not accept it, do not install or run the Software.

Vidima is free to install and free to use with full functionality for 14 days. After 14 days the Software switches to read-only mode (you can still open and print whatever you created during the trial). To unlock writing again you must purchase and activate a license.

8. Cryptographic seal

Every invoice PDF generated by Vidima carries an ECDSA P-256 cryptographic seal embedded in a verification QR code. The seal is tied to your license. Removing, altering, or forging the seal is a violation of this Agreement and may also constitute a violation of Swiss anti-counterfeiting law.

9. Warranty disclaimer

Vidima is provided "AS IS" and "AS AVAILABLE", without warranty of any kind, express or implied, to the maximum extent permitted by Swiss law. This includes (without limitation) any warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

This disclaimer does not limit any warranty Helvecraft is required by mandatory Swiss law to provide.

10. Limitation of liability

Helvecraft does NOT accept liability for any direct, indirect, incidental, consequential, or special damages arising from the use of or inability to use Vidima, except where caused by Helvecraft's intentional misconduct or gross negligence. In any case, Helvecraft's total cumulative liability toward any single Customer shall not exceed the amount that Customer paid for the license.

This clause does not limit any liability Swiss mandatory law forbids us to limit (for example, liability for personal injury or fraud).

13. Governing law and forum

This Agreement is governed by Swiss law. For disputes, where you are a consumer protected by mandatory consumer-protection law the competent courts are those of your domicile (in particular, EU consumers retain their rights under their local consumer-protection law); in all other cases the competent forum is the seat of the company in Ticino, Switzerland.

The Italian-language version of this Agreement is the binding original; translations are provided for reader convenience.
